These Terms of Service ("Terms") constitute a legal agreement between you and 1993 ("we," "us," or "our") governing your use of the 1993 mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

3. User Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Account and Data

The App does not require you to create an account. All data you enter into the App is stored locally on your device. You are responsible for:

• Maintaining the security of your device
• Backing up your data if desired
• Any information you enter into the App

We are not responsible for any loss of data due to device failure, loss, theft, or any other reason.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App

6. Intellectual Property

The App and its original content, features, and functionality are owned by 1993 and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The App will function uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 1993 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party
• Unauthorized access, use, or alteration of your data

Our total liability to you for any damages shall not exceed the amount you paid for the App, if any.

10. Indemnification

You agree to defend, indemnify, and hold harmless 1993 and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the App
• Your violation of any term of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by uninstalling it from your device.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1993 operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1993 regarding your use of the App and supersede all prior agreements and understandings.

15. Waiver

The failure of 1993 to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
